Agreement to Terms

By accessing our website, submitting a form, booking a call, or engaging our services, you agree to be bound by these Terms and Conditions. These terms apply to all visitors, leads, and clients of Telegenics Media, a digital marketing agency based in Durango, Colorado.

If you do not agree with any part of these terms, please do not use our website or services.

Our Services

Telegenics Media provides done-for-you digital marketing services for local home service contractors. Our services include but are not limited to:

  • Google Business Profile optimization and management
  • Automated review request systems
  • Missed call text-back and AI-powered web chat
  • Website design and development
  • Lead capture and automated follow-up systems
  • AI voice agents for inbound and outbound calls
  • SMS marketing campaigns and customer reactivation
  • Monthly performance reporting

Services are delivered as described in the package selected at the time of engagement. Scope, pricing, and deliverables are confirmed prior to setup.

SMS Communications and Opt-In

By submitting your phone number through any form on our website or engaging our services, you expressly consent to receive SMS text messages and calls from Telegenics Media. These communications may include follow-up messages, appointment reminders, service updates, and marketing messages related to our services.

SMS Disclosure: Message frequency varies based on your interaction and the services you have requested. Message and data rates may apply. To opt out of SMS communications at any time, reply STOP. For assistance, reply HELP.

We do not use SMS communications for spam or unsolicited mass outreach. All messages are sent in the context of a legitimate business relationship or following explicit opt-in consent. Opt-out requests are honored immediately and you will not receive further messages after replying STOP.

For clients whose customers are enrolled in automated SMS workflows — such as review requests, missed call responses, or reactivation campaigns — it is the responsibility of the client to ensure their customers have provided appropriate consent to receive such messages. Telegenics Media operates these workflows on behalf of clients in compliance with the Telephone Consumer Protection Act (TCPA) and applicable carrier guidelines.

Client Responsibilities

Clients engaging Telegenics Media agree to:

  • Provide accurate business information necessary to set up and manage their marketing systems
  • Ensure customer contact data shared with Telegenics Media was collected lawfully and with appropriate consent
  • Use the DONE text trigger and other workflow tools as intended and not for any unlawful purpose
  • Respond to onboarding requests in a timely manner to avoid delays in setup
  • Pay agreed monthly fees on time as outlined in their service agreement

Payment and Cancellation

Services are billed monthly with a one-time setup fee charged at the start of the engagement. Monthly fees are due at the beginning of each billing cycle.

There are no long-term contracts. Clients may cancel at any time with written notice. Cancellation takes effect at the end of the current billing period. Setup fees are non-refundable. Monthly fees already paid are non-refundable once the billing period has begun.

Telegenics Media reserves the right to suspend or terminate services for non-payment or violation of these terms.

Market Exclusivity

Where a written market exclusivity guarantee has been provided, Telegenics Media agrees not to onboard a direct competitor in the same trade and geographic market for the duration of the client's active engagement. Exclusivity is trade and market specific and applies only to the tier at which it is offered. Exclusivity is void upon cancellation of services.

Intellectual Property

All website content, copy, graphics, and system configurations created by Telegenics Media remain the intellectual property of Telegenics Media until full payment has been received. Upon cancellation, clients retain ownership of their Google Business Profile, customer data, and any content they originally provided. Website designs and automation workflows built by Telegenics Media may not be transferred or replicated without written consent.

Limitation of Liability

Telegenics Media makes no guarantee of specific results including call volume, lead counts, revenue increases, or Google ranking positions. Digital marketing results vary based on market conditions, competition, business responsiveness, and other factors outside our control.

To the maximum extent permitted by law, Telegenics Media shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or website. Our total liability in any dispute shall not exceed the amount paid by the client in the most recent billing month.

Third-Party Platforms

Our services rely on third-party platforms including GoHighLevel, Google, Twilio, and others. Telegenics Media is not responsible for outages, policy changes, or limitations imposed by these platforms. We will make reasonable efforts to adapt our systems in response to platform changes but cannot guarantee uninterrupted service in all cases.

Changes to These Terms

Telegenics Media reserves the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.

Governing Law

These terms are governed by the laws of the State of Colorado. Any disputes arising from these terms or our services shall be resolved in the courts of La Plata County, Colorado.
